The Federal Fiscal Court has rejected the so-called restructuring decree as inadmissible, as it violates the principle of legality of administrative actions. With this decree corporate restructurings will become more complicated in the future, since restructuring profits made by the companies e.g. through debt waiver are now subject to taxation.
